If you're looking to modify a development consent, Section 4.55 of the Environmental Planning and Assessment Act 1979 (or Section 4.56 if issued by the Land and Environment Court) or formerly known as Section 96 Modification, allows you to do this without needing to apply for a new consent to the Council. However, the modification must only be a "modification without radical transformation".
In order to modify a development consent, you must be either the applicant, owner of the land or an individual who is authorised by the owner to act on their behalf.
